Terms of Service

These terms are an agreement between you and Amber Digital, based in Amsterdam, the Netherlands (“we”, “us”), which makes Testmode. They govern your use of the Testmode application at app.testmode.ai and the website at testmode.ai (together, “Testmode”). If you use Testmode on behalf of a company, you accept these terms for that company, and “you” means the company.

By creating an account or using Testmode, you agree to these terms and to our Privacy Policy.

The service

Testmode is an AI testing tool for web applications. You describe tests in plain language, and an AI tester runs them in a real browser against the applications you choose and reports the results. Testmode is a business service, intended for professional use.

Your account

You must give accurate information when you sign up and keep it up to date. You are responsible for keeping your sign-in details secure and for everything done through your account, including by teammates you invite. Tell us at once at support@testmode.ai if you suspect unauthorised use.

Plans, trials and payment

Paid plans are billed in advance, monthly, in US dollars, through Polar, which acts as our merchant of record and handles checkout, invoicing and taxes. Each plan includes the usage described on our pricing page at the time you subscribe.

A trial requires a payment method. Unless you cancel before the trial ends, your subscription starts automatically and you are charged for your plan. You can cancel at any time from the Billing tab in the app; cancellation takes effect at the end of the current billing period, and fees already paid are not refunded, except where the law requires otherwise.

We may change our prices. We will tell you at least 30 days before a price change affects you, and it applies from your next billing period after that notice.

What you may test

You may only point Testmode at applications you own or are authorised to test. You are responsible for having that permission, and for the credentials and test data you give Testmode. Because the AI tester acts in a real browser, it will do what your tests describe: submit forms, place orders, send messages. We strongly recommend testing staging environments with test accounts, and never pointing a test at a live system where its actions could cause harm or cost.

Acceptable use

You must not use Testmode to:

• test, scan, load or attack systems you are not authorised to test;
• break the law, or infringe anyone’s rights;
• send spam, or create accounts or content on third-party services in bulk;
• get around CAPTCHAs, rate limits or other access controls on sites you do not control;
• interfere with Testmode or its infrastructure, probe it for vulnerabilities without our written permission, or reverse engineer it;
• resell or provide Testmode to others, or build a competing product with it.

We may suspend or end access that breaks these rules, and will tell you why unless the law or security prevents it.

Your content

You keep all rights to what you put into Testmode — your test cases, settings, credentials and the data the AI tester captures from your applications (“your content”). You give us permission to host, process and display your content only as needed to provide Testmode to you. We do not use your content to train AI models. You are responsible for your content and for having the right to use it with Testmode.

Where your content includes personal data, our Privacy Policy explains how we handle it, and on request we will sign a data processing agreement with you.

Our service and intellectual property

Testmode, including its software, design and documentation, belongs to us and our licensors. We give you a limited, non-exclusive, non-transferable right to use it during your subscription under these terms. If you send us feedback or suggestions, we may use them without obligation to you.

AI output

Testmode uses AI models to interpret tests, operate the browser and judge results. AI output can be wrong: a test may pass when your application has a defect, or fail when it does not. Testmode helps you find problems; it does not guarantee that your software is free of them, and you remain responsible for the decision to release it.

Availability and changes

We work to keep Testmode available and reliable, but we do not guarantee that it will be uninterrupted or error-free. We may improve, change or remove features. If we remove a feature that is central to a paid plan, we will tell you in advance, and you may cancel.

Disclaimers

Except as expressly stated in these terms, Testmode is provided “as is” and “as available”, and to the extent the law allows we disclaim all implied warranties, including of merchantability, fitness for a particular purpose and non-infringement.

Limitation of liability

To the extent the law allows, we are not liable for indirect or consequential loss, lost profits, lost revenue or lost data, or for the consequences of actions the AI tester takes in an application you pointed it at. Our total liability arising out of or relating to these terms in any twelve months is limited to the amount you paid us for Testmode in those twelve months. Nothing in these terms limits liability for fraud, intent or gross negligence, or any liability that cannot be limited by law.

Indemnity

You will defend and compensate us against third-party claims arising from your content, from applications you test without authorisation, or from your breach of these terms.

Ending the agreement

You may stop using Testmode and delete your account at any time. We may suspend or end your access if you seriously or repeatedly break these terms, or if you do not pay. When your account ends, your right to use Testmode ends, and we delete your content as described in our Privacy Policy.

Changes to these terms

We may update these terms. The date at the top shows when they last changed. If a change is significant, we will tell account holders by email at least 30 days before it takes effect. Continuing to use Testmode after that date means you accept the new terms.

Law and disputes

These terms are governed by the laws of the Netherlands. Disputes will be brought before the competent court in Amsterdam, unless mandatory law gives you the right to go to court elsewhere.
